On August 22, 2025, the Kentucky Council on Postsecondary Education and the DOJ filed a joint motion for a consent judgment agreeing to end in-state tuition access for undocumented students. MALDEF filed a motion to intervene the same day on behalf of a student association, but the judge has not yet ruled on either motion.
